By accessing, registering for, or participating in the Negotiation Stories website, community, or related services (collectively, the “Site”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not access or use the Site.

1. Nature and Purpose of the Site

Negotiation Stories is a community and educational platform designed to collect, share, and distribute real-world stories, reflections, and experiences related to negotiation, conflict resolution, leadership, and communication. Content shared on the Site is for educational and informational purposes only and does not constitute legal, professional, medical, or psychological advice.

2. Eligibility and Participation

Participation is limited to individuals 18 years of age or older. By registering for an account or submitting content, you represent and warrant that you meet this requirement and have full legal capacity to enter into this agreement.

3. User Content Definition

“User Content” includes, but is not limited to:

• Written stories, posts, comments, or testimonials

• Audio or video recordings

• Images, photographs, likenesses, voices, usernames, biographies, or other identifying information

• Any materials uploaded, submitted, posted, or otherwise shared on the Site

4. Comprehensive Content Release & License Grant

By submitting User Content to Negotiation Stories, you irrevocably grant Negotiation Stories, its owner, moderator, partners, successors, assigns, licensees, and affiliates the following rights:

a. Use & Media Rights

A perpetual, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, record, edit, modify, adapt, translate, publish, publicly display, publicly perform, distribute, transmit, archive, and otherwise exploit your User Content, in whole or in part, in any format or medium now known or later developed, including but not limited to:

• Websites and digital platforms

• Educational and training materials

• Social media, marketing, and promotional materials

• Print publications, books, articles, and reports

• Audio, video, documentary, and multimedia productions

b. Likeness, Voice, and Identity Release

To the extent applicable, you grant permission for the use of your name, likeness, image, voice, biographical information, username, and personal story, with or without attribution, in connection with the User Content and related materials.

You acknowledge and agree that:

• No compensation is owed for such use

• You waive any right to inspect or approve finished materials

• Negotiation Stories has no obligation to use or continue using your content

5. Waiver and Release of Claims

You hereby fully and irrevocably waive, release, and discharge Negotiation Stories and its owner, moderator, and affiliates from any and all claims, demands, causes of action, liabilities, damages, or expenses arising out of or related to:

• The use, display, distribution, or modification of your User Content

• Any editing, re-contextualization, excerpting, or presentation of content

• Alleged defamation, invasion of privacy, or violation of publicity or moral rights

• Copyright or intellectual property claims relating to your submission

This waiver applies to the fullest extent permitted by law.

6. Representations, Warranties, and Indemnification

By submitting User Content, you represent and warrant that:

• You are the sole owner of the content or have full authority to grant the rights herein

• Any individuals referenced have consented or are sufficiently anonymized

• The content does not violate confidentiality obligations, court orders, or contractual restrictions

• The content does not infringe intellectual property, privacy, or publicity rights

• The content is truthful to the best of your knowledge

You agree to indemnify and hold harmless Negotiation Stories from any claims arising from a breach of these representations.

7. Third-Party Information and Sensitive Content

You agree not to submit:

• Confidential, proprietary, or legally restricted information

• Information subject to non-disclosure or fiduciary obligations

• Personally identifiable or sensitive information of third parties without consent

Negotiation Stories assumes no responsibility for disputes arising from user-submitted content.

8. Moderation, Editorial Control, and Removal

Negotiation Stories is moderated by Joshua N. Weiss.

Joshua N. Weiss reserves the right, but not the obligation, to:

• Review, edit, curate, or remove content at his sole discretion

• Decline to publish or continue hosting any User Content

• Restrict, suspend, or terminate user participation without notice

Participation in the community is a privilege, not a right.

9. Intellectual Property Ownership

All Site design, branding, trademarks, logos, original text, and curated materials—excluding User Content—are the intellectual property of Negotiation Stories and may not be reproduced or distributed without prior written permission.

10. Disclaimer of Guarantees

All content is provided “as is” and without warranties of any kind. Negotiation Stories makes no representations regarding outcomes, effectiveness, or applicability of any information shared.

11. Limitation of Liability

To the maximum extent permitted by law, Negotiation Stories shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from participation in or reliance upon the Site or its content.

12. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, United States of America, without regard to conflict-of-law principles.

13. Changes to These Terms

Negotiation Stories reserves the right to modify these Terms at any time. Continued use of the Site constitutes acceptance of any revised Terms.
